These Terms of Service govern access to and use of tutiboutique.com and purchases from Tuti Boutique. The store is hosted by Shopify, which provides the commerce platform used to offer products and services.
Agreement to these terms
By visiting the site, creating an account, or placing an order, you agree to these terms and the policies linked from the site. If you do not agree, do not use the site. You must be at least the age of majority in your place of residence, or use the site with the permission and supervision of a parent or legal guardian.
Store information and changes
We may update products, prices, features, and these terms. Changes apply when posted and do not alter rights or obligations that already arose unless applicable law permits. We may suspend or discontinue part of the site when reasonably necessary.
Product information
We work to display product descriptions, colors, measurements, availability, and images accurately. Screen settings and production variations can affect appearance, and measurements are approximate unless stated otherwise. We may correct errors and update information without prior notice. Nothing in this section limits rights relating to defective or misdescribed products.
Prices, taxes, and payment
Prices are shown in the currency displayed on the site and may change before an order is submitted. Shipping, taxes, duties, and other charges are shown at checkout when they can be calculated. You authorize us and our payment providers to charge the selected payment method for the order total.
You represent that payment, billing, and contact information supplied for an order is accurate and that you are authorized to use the payment method.
Orders
An order confirmation acknowledges receipt of your order; it does not guarantee acceptance. We may limit quantities or cancel an order for legitimate reasons, including inventory errors, suspected fraud, pricing errors, sanctions or legal restrictions, or inability to ship to the destination. If we cancel a paid order, we will refund the cancelled amount to the original payment method.
Requests to cancel or change an order must be submitted within 15 minutes after purchase. Acceptance depends on whether fulfillment has begun.
Shipping and returns
Delivery is governed by our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Return and Refund Policy. Those policies form part of these terms.
Accounts and security
You are responsible for maintaining the confidentiality of account credentials and for activity performed through your account. Notify us promptly if you believe an account has been accessed without authorization. Do not provide false information, impersonate another person, or use another person's payment method without permission.
Acceptable use
You may not use the site to violate law or another person's rights; distribute malicious code; interfere with security or operation; scrape, copy, or exploit content through automated means without permission; submit deceptive information; or attempt unauthorized access to the site, accounts, or connected systems. We may restrict access for conduct that violates these terms.
Intellectual property
The site design, text, graphics, logos, photographs, product presentation, and other content owned by or licensed to Tuti Boutique are protected by applicable intellectual-property laws. These terms grant a limited, revocable, non-transferable right to use the site for personal shopping. No content may be reproduced, sold, or commercially exploited without written permission from the applicable owner.
Reviews and submissions
If you submit a review, image, comment, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person's rights. You grant Tuti Boutique a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and adapt that submission for operating and promoting the store. We may moderate or remove submissions that violate these terms.
Third-party services and links
The site may use or link to services operated by Shopify, payment providers, carriers, social networks, and other third parties. Their services are governed by their own terms and privacy notices. We are not responsible for third-party content or services except to the extent required by law.
Disclaimers
To the maximum extent permitted by law, the site and its general informational content are provided on an “as available” basis. We do not promise that access will always be uninterrupted, timely, secure, or error-free. Product warranties and consumer guarantees that cannot legally be excluded remain fully effective.
Limitation of liability
To the maximum extent permitted by law, Tuti Boutique is not liable for indirect, incidental, special, punitive, or consequential losses arising from use of the site. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or mandatory consumer rights.
Indemnification
To the extent permitted by law, you agree to indemnify Tuti Boutique against third-party claims and reasonable costs caused by your unlawful use of the site, your breach of these terms, or your violation of another person's rights. This provision does not apply where prohibited by consumer law.
Governing law
These terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-law rules. Mandatory consumer protections in your place of residence continue to apply where they cannot be waived. Courts with lawful jurisdiction may hear disputes.
Severability and waiver
If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver of that provision.
